When you purchase artwork from Derek Johnson Fine Art Photography, you receive ownership of the physical artwork only.

Digitally distribute the image
Create derivative works
Use the artwork commercially
License the artwork to others

All reproduction and commercial rights remain exclusively with JPS Enterprise LLC.

Personal Display Rights

Collectors may display purchased artwork for personal enjoyment in homes, offices, and private spaces.

Any commercial use, reproduction, publication, or redistribution requires prior written permission from JPS Enterprise LLC.

Artwork Purchases

When you purchase artwork, you agree that:

Artwork details have been reviewed before purchase
Dimensions, materials, and finishing options have been selected intentionally
Shipping information provided is accurate
Payment information submitted is valid

Because artwork is produced specifically after purchase, orders enter production shortly after checkout.

Artwork is currently available for delivery within the United States only.

Capacity to Contract

Capacity to Contract. By making a purchase, you represent that you are at least 18 years of age, or the age of legal majority in your jurisdiction of residence, and that you have the legal capacity to enter into these Terms.

Made-to-Order Artwork

Fine art photography purchased through Derek Johnson Fine Art Photography is created specifically for each collector.

Because each piece is created after purchase:

Orders cannot be returned due to preference changes
Orders cannot be exchanged due to incorrect size selection
Cancellation requests are limited to orders that have not entered production

Damaged, defective, or incorrect orders are addressed under our Shipping & Returns policy.

Open Edition Artwork

Artwork is currently offered as open editions. Open editions are produced without a predetermined production limit, with the same commitment to quality and presentation as any work in the collection.

Limited Edition Artwork

When limited editions are offered, each represents a defined and intentional release of a photograph.

Each limited edition:

Has a predetermined production quantity
Includes edition documentation
Is tracked as part of the artwork's provenance
Is permanently retired once sold out

Once a limited edition reaches its final release, it will not be reproduced.

JPS Enterprise LLC reserves the right to determine edition structure, release timing, and availability.

Certificates of Authenticity

A Certificate of Authenticity documents artwork information such as title, edition details, medium, dimensions, and authentication information.

Limited editions — when offered, a Certificate of Authenticity is included with the artwork.
Open editions — a Certificate of Authenticity may be provided at the artist's discretion.

Certificates document the artwork's provenance but do not transfer copyright or reproduction rights.

Pricing and Availability

Artwork pricing, availability, sizes, materials, and product offerings may change at any time.

JPS Enterprise LLC reserves the right to:

Update pricing
Modify available artwork offerings
Correct pricing or description errors
Limit availability where appropriate

Changes do not affect completed purchases.

Order Acceptance

Submitting an order does not guarantee acceptance.

JPS Enterprise LLC reserves the right to refuse or cancel orders when necessary, including situations involving:

Pricing errors
Suspected fraud
Incorrect information
Unavailable artwork

If an order is canceled after payment has been processed, you will be notified and refunded in full.

Website Content Accuracy

We make reasonable efforts to ensure that artwork descriptions, images, dimensions, and information displayed on this website are accurate.

Slight differences may occur due to screen displays, monitor calibration, device settings, and the natural characteristics of print materials. Such differences do not constitute defects.

Limitation of Liability

To the maximum extent permitted by law, JPS Enterprise LLC's total liability for any claim arising from a purchase shall not exceed the amount you paid for the specific product giving rise to the claim. In no event shall JPS Enterprise LLC be liable for any indirect, incidental, consequential, special, or punitive damages, even if advised of the possibility of such damages.

Indemnification

Dispute Resolution; Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, your purchase, or any product sold by JPS Enterprise LLC shall be resolved exclusively through binding individual arbitration administered under the Federal Arbitration Act (9 U.S.C. §§ 1 et seq.), rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. This agreement to arbitrate does not apply to intellectual property claims brought by JPS Enterprise LLC. YOU AND JPS ENTERPRISE LLC EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Any arbitration will be conducted on an individual basis only, and the arbitrator shall have no authority to consolidate claims of more than one person. If any part of this arbitration provision is found unenforceable, the remainder shall remain in full force, except that the class-action waiver may not be severed from the obligation to arbitrate; if the class-action waiver is found unenforceable, the entire arbitration provision shall be null and void, and disputes shall proceed in the courts specified below.

Governing Law; Venue

Governing Law; Venue. These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles. For any dispute not subject to arbitration, or to enforce an arbitration award, the parties consent to the exclusive jurisdiction and venue of the state courts of Mecklenburg County, North Carolina, or the United States District Court for the Western District of North Carolina.

Changes to These Terms

JPS Enterprise LLC may update these Terms of Service periodically. Updated Terms will be posted on this website with a revised effective date. Continued use of the website after changes are posted constitutes acceptance of the updated Terms.
